GivePanda is run by GivePanda, LLC. These terms apply to anyone who uses givepanda.com — to start a page, to give to one, or just to read. By using the site you agree to them. They are written to be read, not skimmed; if a sentence is unclear, write to hello@givepanda.com.
What GivePanda is
GivePanda lets a person raise money from the people who know them for medical care their insurance will not cover, and lets those people give it. We provide the page, take the payment, and pay the organiser out. We are not a charity, a bank, a lender, or a medical provider, and nothing on the site is medical, legal, tax, or financial advice.
Your account
You must be 18 or older to hold an account. Keep your password to yourself; what happens under your account is your responsibility until you tell us it has been compromised.
If you start a page
- Everything on your page must be true, and the situation must be your own or one you have permission to raise for.
- Money you receive must be used for the purpose your page describes.
- You own what you write and the photos you add. You give us permission to show them on your page, on our Browse page, and in the previews that appear when your page is shared, for as long as your page is live.
- Do not add a photo of anyone who has not agreed to appear, and do not add anything you do not have the right to use.
- A page may be read by a person before it goes live, and we may ask for more information — including confirmation from a clinic — at any time.
If you give
A gift on GivePanda is a personal gift to the organiser. It is not a charitable donation, it is not tax-deductible, and you receive nothing in return for it. Once a gift is made it is not refundable, except where the law requires or where we decide, in a particular case, that it should be. If you believe a page is not what it claims to be, tell us and we will look into it.
Fees
Starting a page is free. A 3% platform fee and a processing fee of 2.9% + 30¢ come out of each gift before it reaches the organiser; on a $100 gift, $93.80 reaches the page. A supporter may add a tip for GivePanda on top of a gift; a tip is never taken from what the organiser receives. Fees may change; if they do, the change applies only to gifts made after it.
Payouts
Money is paid to the organiser through Stripe. Before the first payout the organiser must verify their identity, and we may hold a payout while we look into a page or a gift. Payouts are made in the amounts and at the times shown on your account.
Pages that started somewhere else
Some pages on GivePanda were created on a partner organisation's site, which uses GivePanda's technology. Those pages are edited there, and their organisers are bound by that site's terms as well as these. A gift made here is handled by GivePanda under these terms whichever site the page began on.
What we can do
We may decline to publish, pause, end, or remove a page, hold or reverse a payout, or close an account, where we believe a page is untrue, a gift is fraudulent, these terms have been broken, or the law requires it. We will tell you when we do, and why, unless the law prevents us.
What you may not do
- Raise money for something other than what your page says.
- Give using a card that is not yours, or a gift you intend to reverse.
- Harass an organiser or a supporter, on the site or off it.
- Scrape, probe, overload, or interfere with the site.
What we do not promise
We cannot promise that any page will raise any amount, that any treatment will succeed, or that the site will always be available. GivePanda is building a financing service, Gap Match, which is not currently available; nothing on the site is an offer of credit.
Liability
To the fullest extent the law allows, GivePanda, LLC is not liable for indirect or consequential loss arising from use of the site, and our total liability to you for any claim is limited to the fees we received from gifts to your page in the twelve months before the claim arose. Nothing in these terms limits liability that cannot be limited by law.
Ending things
You can end a page or close your account at any time by writing to us. Ending a page stops it taking gifts and takes it off the site; money already given remains the organiser's, subject to these terms.
The law that applies
These terms are governed by the laws of the United States and of the state in which GivePanda, LLC is organised. If we have a disagreement, write to us first; most things can be sorted out in an email.
Changes
When these terms change, the date at the top changes with them, and if a change matters to how you use the site we will email account holders before it takes effect.
